On September 23, 2005 at the Opening Session of the International Tribunal on Haiti, the former Director General of the Haitian National Police L�on Charles, the former United Nations Force Commander Lieutenant General Augusto Heleno Ribiero Pereira of Brazil, and the present Special Representative of the United Nations Juan Valdes of Chile were convicted of violations of Haitian law and international law including crimes against humanity and murder. The verdicts of the Tribunal and other evidence will be used to generate a case to be referred to the International Criminal Court. A copy of the initial indictment is attached. All of those indicted, including MINUSTAH officials, received summons to appear before the International Tribunal on Haiti. However, no one has yet responded. The Tribunal, through its Commission of Inquiry led by former U.S. Attorney General Ramsey Clark, has conducted fact-finding inquiries in Haiti and in the United States. In Haiti, the Commission did receive cooperation from Mario Andresol of the PNH. Unfortunately, MINUSTAH and UN CIVPOL officials were not as cooperative. The Commission will continue to investigate reports of human rights violations. The second session of the Tribunal will be held November 19, 2005 in Boston. Because the Commission is convinced that you believe in the principle that no one should escape accountability for acts of terror, we urge you to encourage MINUSTAH officials to fully cooperate with the on-going investigation of the Commission of Inquiry and to assist the Commission in its search for the truth. Just as the United Nations is currently urging Syria to fully collaborate with the independent UN commission investigating the assassination of Lebanon�s former Prime Minister Rafiq Hariri, we trust you will not allow any form of obstruction of the Tribunal�s efforts to bring the perpetrators of violence against innocent Haitians to justice.
